Position Overview
The Litigation Attorney will assume a leadership role in representing clients, overseeing complex personal injury cases from initiation through resolution. We seek a seasoned professional with substantial trial experience in both state and federal courts, equipped to manage sophisticated caseloads with precision and determination.
Key Responsibilities
Federal Civil Litigation:
Prepare and file meticulously crafted legal documents, including complaints, motions to dismiss, motions for summary judgment, and pre-trial submissions, in strict adherence to the Federal Rules of Civil Procedure.
Manage comprehensive discovery processes, drafting and responding to interrogatories, requests for production, and requests for admission, while ensuring compliance with federal disclosure obligations.
Advocate for clients in federal court proceedings, including motion hearings, evidence presentation, and delivery of compelling trial arguments before juries or judges.
Oversee federal case timelines, including Rule 26 disclosures, expert designations, and pre-trial conference preparations, with meticulous attention to detail.
State Civil Litigation:
Draft and submit precise pleadings and motions in state court, such as complaints, demurrers, motions to strike, and motions in limine, in accordance with the California Code of Civil Procedure.
Administer state-specific discovery, including the preparation and response to form and special interrogatories, document demands, and meet-and-confer obligations as required by judicial mandates.
Represent clients in state court trials and hearings, skillfully examining witnesses, presenting exhibits, and advocating before Superior Court judges or juries.
Navigate state court procedural requirements, including case management conferences, mandatory settlement conferences, and trial readiness proceedings, with strategic foresight.
Conduct and defend depositions of witnesses, parties, and experts with professionalism and confidence in both federal and state jurisdictions.
Maintain direct, effective communication with clients, opposing counsel, and judicial officers across state and federal forums.
Perform thorough case investigations through client consultations, identifying pivotal issues and formulating strategies for settlement or trial tailored to each jurisdiction.
Assemble robust trial presentations by collecting evidence, interviewing witnesses, and directing investigations that withstand scrutiny in state or federal courts.
Prepare clients for mediation, settlement discussions, and trial proceedings, ensuring they are fully informed and strategically positioned.
Advise clients on their legal rights and responsibilities, providing clear guidance that accounts for jurisdictional distinctions.
Draft and file impactful complaints, motions, and pleadings designed to advance client interests in both state and federal courts.
Represent clients in courtroom proceedings, delivering persuasive advocacy in state and federal trials.
